Please read these terms carefully before using our services.

Introduction

These Terms & Conditions govern your use of Unplanned Diaries services. By booking or using our website, you agree to comply with these terms.

Part A: General Use & Platform Terms

Acceptance & Binding Nature

By accessing our website, mobile app, or using our services (directly or via agents), you accept and agree to be bound by these Terms. If you disagree with any clause, you shouldn’t proceed with bookings or use of our services.

Definitions

  • Client / Traveller / You: the person making a booking or using our services.
  • Independent Contractors / Service Providers: third parties (airlines, hotels, transport operators, activity vendors) that deliver parts of your trip.
  • Package / Tour / Trip: a travel product or itinerary coordinated by us.
  • Platform: our website, apps, booking forms, WhatsApp or official communication channels.
  • Short-Haul / Domestic and Long-Haul / International: categories of destinations (check applicable booking).

Eligibility

  • You must be at least 18 years old (or act with legal authorization for someone else).
  • All provided information must be accurate, complete, and lawful.
  • We reserve the right to refuse service or cancel bookings if eligibility or information is not satisfied.

Use of Platform & Communications

  • Use our platform only for lawful, non-commercial purposes.
  • Keep contact info current; communications are sent via email, SMS, WhatsApp.
  • We are not liable for failed communications due to incorrect contact info.

Permitted & Prohibited Conduct

Permitted:

  • Make legitimate inquiries, bookings, and interact with support.
  • Provide required information for your and co-traveller's bookings.

Not Permitted:

  • Impersonation, fraudulent bookings, false identities.
  • Misuse of platform (spamming, interfering with system, reverse engineering).
  • Use of content (itineraries, images, pricing) commercially without consent.

Termination or Suspension

We may suspend or terminate your access without notice if you breach these Terms, provide misleading info, harm our reputation, or interfere with the platform. Termination does not relieve you of obligations already incurred.

Part B: Travel Service Terms & Conditions

Scope of Services

We coordinate group tours, custom itineraries, flights, hotels, transport, and local experiences, often fulfilled by independent providers.

Booking & Contract Formation

  • Booking initiated by selecting a package, confirming details, and paying required amounts.
  • Booking confirmed only via written confirmation or voucher.
  • Quotations and inclusions are tentative until final confirmation.
  • If booking for others, you must have authority and communicate these Terms to all travellers.

Payment Policy

  • Advance deposits, interim, and final payments apply depending on trip type.
  • Visa fees or special deposits may be non-refundable/non-transferable.
  • Currency, tax, or levy differences may be passed to you.
  • Payments should be made to official accounts only; we are not liable for fraudulent transfers.

Modifications & Rescheduling

By Traveller:

  • Requests in writing before cutoffs; one free reschedule may be allowed.
  • Name changes or transfer may incur extra charges.

By Us (Unplanned Diaries):

  • Rare circumstances (vendor issues, regulatory disruptions) may change itinerary.
  • Comparable alternatives, credit, or partial refunds offered per vendor terms.

During the Trip

Itinerary changes may occur due to weather, safety, or local constraints. Cooperation is required; no refunds for missed services mandated by external factors.

Flight, Airline & Related Terms

  • We facilitate flight booking; airline policies apply.
  • Ticket issuance, fare rules, changes, or cancellations per airline policy.
  • Not responsible for airline delays, cancellations, baggage loss, or in-flight services.

Cancellation & Credit Notes

  • Traveller must cancel in writing; credit notes issued after deducting non-refundable components.
  • Validity period, non-transferable, applied toward packages only.
  • We may cancel operationally; credit/partial refunds per vendor terms.

Travel Insurance & Health Disclosures

Comprehensive travel insurance is recommended. Health disclosures may be required for adventure activities; non-disclosure absolves us of liability.

Travel Documents, Visas & Entry Requirements

Travellers are responsible for passports, visas, permits, vaccinations. Visa facilitation is provided but approval is at consulate discretion.

Adventure Activities & Risk Assumption

Participation in optional adventure activities is voluntary. Follow safety instructions; we are not liable for injury or loss.

Limitation of Liability & Independent Contractors

Services are coordinated by us but fulfilled by third parties. Maximum liability limited to amounts paid; no indirect, incidental, or consequential losses.

Accommodation & Hotel Terms

Standard check-in/out applies; room requests are preferences. Operational changes communicated with alternative arrangements.

Transfers, Sightseeing & Transport

Transfers follow itinerary. Delays caused by traveller or external disruptions are outside our liability.

Luggage, Personal Belongings & Risk

Responsible for luggage and personal items; we are not liable for theft or damage. Baggage liability governed by transport provider.

Force Majeure

Not liable for failure/delay due to events beyond control (natural disasters, strikes, pandemics). May reschedule, provide credit, or cancel per vendor policy.

Part C: Legal Relationship & Miscellaneous

Code of Conduct

Behave respectfully toward fellow travellers, staff, locals, and comply with local laws and cultural norms. Disruptive or unsafe behavior may lead to removal without refund.

Indemnification

You agree to indemnify, defend, and hold us harmless from claims, losses, or costs arising from your breach, negligence, or misconduct.

Grievance Redressal & Escalation

Contact Customer Support first. If unresolved within 30 days, escalate to management or arbitration. Keep booking docs, proofs, and correspondence.

Governing Law, Disputes & Jurisdiction

Terms governed by laws of [Your State/Country]. Amicable negotiation first, then mediation/arbitration with seat in [City]. Courts in [City] have exclusive jurisdiction unless arbitration selected.

Intellectual Property

All content is our property or licensed. Do not reuse, reproduce, republish, or commercially exploit without permission.

Third-Party Links & External Sites

Platform may contain external links. We are not liable for content or issues from third-party sites.

Amendments to Terms

We may update these Terms anytime. Continued use after changes implies acceptance.

Entire Agreement & Severability

These Terms form the complete agreement. If any clause is invalid, the rest remain in force.
